What is a workers' comp activity check?
It is lawful surveillance of an injured worker in public places, usually over one to a few days, to document activity levels. A licensed PI agency records what the claimant does, such as lifting, driving or working elsewhere, so the adjuster and counsel can compare it to documented work restrictions.
When an Activity Check Makes Sense
Surveillance should be tied to something in the file, not ordered by habit. Common triggers include a tip from a coworker or neighbor that the claimant is working elsewhere, social posts showing strenuous activity, a claimant who repeatedly misses appointments, or a recovery that stalls without clear explanation. A defense attorney may also want current activity documented before a mediation or hearing.
When the file has no specific concern, a background and records review may be a better first spend than fieldwork. Birds Eye will say so.
Why the Restrictions in the File Drive the Plan
An activity check is only useful if someone can compare it to something. The benchmark is usually the documented restrictions in the file: lifting limits, no overhead reaching, no driving, limited standing. Our PIs need to know those limits so they plan coverage around activities that would actually matter, such as a weekend yard project or a second job loading trucks.
Our PIs do not make medical judgments. The report describes what was observed. Whether it is inconsistent with the claimed injury is for the treating physician, the adjuster and counsel to weigh.
Methods That Keep the Evidence Usable
Workers' comp surveillance follows the same limits as any other Tennessee PI work. Our PIs observe from public places, do not trespass onto the claimant's property, do not place tracking devices, and do not create pretext situations designed to make the claimant perform a task. Staged activity damages credibility and can create liability for the carrier.
We also do not contact a claimant who is represented by counsel. Questions about communication with the claimant go through the adjuster or defense attorney.

Reports Written for Adjusters and Defense Counsel
Each report contains a timeline of observations, continuous video segments where the activity was visible, and a clear note of periods when the claimant was not seen. We report long periods of inactivity with the same care as activity, because a check showing limited movement is also relevant.
Tennessee workers' compensation disputes are handled through the Bureau of Workers' Compensation and the courts. If a PI's observations are needed there, the PI can testify about what they saw. Counsel will decide when and how the report is used.
Timing Coverage Around the Claim Calendar
Timing matters. Coverage on the days around a medical appointment shows the claimant's routine on a known travel day. Coverage on a weekend may capture activities not seen on weekdays. Coverage close to a hearing or mediation gives counsel current information.
Our PIs will recommend dates based on the file and the claimant's known routine, and the written scope will list them before any work begins.

Neighborhood canvassing can alert the claimant and raise privacy concerns, so it is only done when scoped with the client and counsel. We never contact a claimant who has an attorney, and we never misrepresent who we are.
Do you review the claimant's social media?
We review publicly available content only. Our PIs do not create fake profiles, send friend requests or message claimants. Public posts are preserved with dates so they can be compared with fieldwork.

A short records and open-source review before surveillance often improves results. Public posts can reveal hobbies, events or a side business. Business filings can show whether the claimant owns a company. Vehicle and address information confirms where coverage should start. Only publicly available content is reviewed; our PIs do not friend, follow or message the claimant under a false identity.
The review can also show that surveillance is not needed at all, which saves the client the cost of fieldwork.
